Terms of Service (LuxyB)

By creating an account or using LuxyB (the “Platform”), you agree to these Terms and to our Privacy Policy, Cookie Notice, DMCA/Notice-and-Notice Policy, and Community Guidelines (collectively, the “Terms”). If you do not agree, do not use the Platform.

1. Eligibility

  • You must be 18+ (or the age of majority in your jurisdiction) to use the Platform and to access NSFW (18+) content.

  • You represent your signup info is accurate and kept up to date and that you will safeguard your credentials.

2. Service Overview

LuxyB hosts and facilitates access to creator content (text, images, audio, video, livestreams, etc.) via subscriptions, tips, PPV, and similar features. LuxyB is a hosting/intermediary platform—not the publisher of all user content.

3. Content Rules & Prohibited Conduct

You may not post, request, promote, sell, or transact any content or activity that is:

  • Illegal, fraudulent, defamatory, hateful, bullying/harassing, inciting violence, or otherwise unlawful.

  • Involving minors (anyone under 18) real or simulated; exploitation; trafficking; non-consensual acts; bestiality; incest; doxxing; threats; extortion; or sexualized deepfakes of real people without verifiable consent.

  • Infringing intellectual property, privacy, publicity, or other rights.

  • Violating sanctions/embargoes/export controls (e.g., OFAC/EU/UK/Canada).

We may remove content and suspend/terminate accounts for violations. See Community Guidelines for details.

4. NSFW & Age Gates

Access to NSFW requires confirming you are 18+ and may involve age-verification steps. Creators must label content SFW/NSFW correctly and ensure all legal consents and records exist.

5. Creator Compliance (U.S., Canada, Mexico & International)

Creators represent and warrant that:

  • All persons depicted in sexual content are 18+ and gave verifiable consent.

  • U.S. 18 U.S.C. §2257 / 28 C.F.R. §75 (if applicable): you maintain required age/identity records and display a proper 2257 statement.

  • Canada: you comply with the Criminal Code (e.g., prohibitions on child sexual abuse material and non-consensual distribution of intimate images), privacy, and provincial laws.

  • Mexico: you comply with criminal, civil, and data protection laws (including ARCO rights mechanisms).

  • International: you comply with local laws regarding obscenity, privacy, data protection, IP, consumer protection, and advertising.

LuxyB may geoblock content/jurisdictions, require KYC/KYB, and cooperate with lawful requests.

6. IP Ownership & Licenses

  • You retain your rights in your content.

  • You grant LuxyB a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, process, reproduce, adapt (for formatting), display, distribute, and promote your content for operating and improving the Platform.

  • Buyers receive a limited personal license to view content they purchase; no redistribution/sublicensing.

7. Payments, Fees, Taxes & Refunds

  • Plans: Support ($9/month) and VIP ($29/month); regional pricing/taxes may apply.

  • Auto-renewal monthly until canceled (settings → billing).

  • Refunds: digital content is generally non-refundable once accessed/consumed, except where required by law or at our discretion.

  • Chargebacks may lead to removal of access and/or account review.

  • Creator payouts may require KYC/KYB, AML/CTF screening, permitted jurisdictions/methods; LuxyB may hold/adjust payouts for fraud/chargebacks/disputes/compliance checks.

8. AML/CTF, Sanctions & Restricted Regions

We may block transactions, suspend accounts, hold funds, or apply geoblocks to comply with AML/CTF and sanctions regimes (OFAC/EU/UK/Canada, etc.).

9. Third-Party Services

LuxyB integrates with third-party payment, storage/CDN, analytics, messaging, or verification providers. Their terms and privacy policies apply.

10. Safety & Interactions

Be respectful. No harassment, doxxing, grooming, scams, impersonation, or exploitation. Report abuse at info@luxyb.com and contact local authorities for emergencies.

11. AI & Synthetic Content

If you use AI, do not create/upload non-consensual sexual deepfakes or content that violates these Terms or law. Clearly label synthetic content when it could be misleading.

12. Termination

We may suspend or terminate accounts for violations or legal risk. You may close your account at any time; we may retain certain records to meet legal/financial obligations.

13. Disclaimers & Limitation of Liability

The Platform is provided “as is” and “as available.” To the maximum extent allowed by law, LuxyB is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages; nor for user content or third-party acts. Our total aggregate liability will not exceed the greater of USD 100 or the amount you paid to LuxyB in the 12 months preceding the claim, unless law requires otherwise.

14. Indemnity

You will indemnify and hold harmless LuxyB and its owner from claims, damages, and costs (including legal fees) arising from your content, conduct, or violation of these Terms or third-party rights.

15. Consumer Rights

Nothing here limits non-waivable consumer rights under applicable laws (e.g., U.S. state laws, Canada provincial laws, Mexico, EU/UK if applicable).

16. Governing Law & Dispute Resolution

  • U.S. users: these Terms are governed by the laws of Delaware, USA (conflict-of-law rules excluded). Disputes are resolved by binding individual arbitration under AAA/JAMS rules; no class actions. You may opt out within 30 days of accepting these Terms by emailing info@luxyb.com. Small-claims court remains available.

  • Canada/Mexico/International users: governed by the laws of British Columbia, Canada and applicable federal laws; exclusive jurisdiction and venue in the courts of British Columbia, subject to any non-waivable local consumer rights.

17. Changes

We may update these Terms and will post the new version and effective date. Continued use means acceptance.

18. Miscellaneous

No assignment by you without our consent; we may assign in corporate transactions. If any provision is unenforceable, the remainder remains in effect. Failure to enforce is not a waiver. This English version controls.
